Effective date: November 1, 2026
These Terms of Service ("Terms") are an agreement between you and Fifty & North, the business name under which Kevin Tantillo, a sole proprietor based in Georgia, USA, does business (Kevin Tantillo dba Fifty & North) ("Fifty & North," "we," "us"). They cover your use of fiftyandnorth.com (the "Site") and any plan, review, call, add-on or Trail Notes product you buy (the "Services"). By buying, booking a call, or ticking "I agree" at checkout, you accept these Terms. If you don't agree, please don't buy.
1. What we do, and what we don't
We plan. You book. Fifty & North provides custom trip itineraries and planning advice only: day-by-day plans, research, route and activity suggestions, backup options, and links to official booking pages.
We are not a travel agency, tour operator, outfitter or guide. We do not book, reserve, hold or pay for any transportation, lodging, campsites, permits, tours, rentals or other travel services. We don't collect, hold or handle money for any travel supplier or for your travel costs, and we don't receive commissions from them. The only payments we take are for our own planning services. You make every reservation and purchase yourself, directly with the supplier, under that supplier's own terms, prices, availability and cancellation policies. Fifty & North isn't a party to those contracts and isn't responsible for any supplier's acts, omissions, prices, changes, cancellations, bankruptcy or failure to perform.
Permit coaching (add-on) means we guide you through a permit lottery or reservation step by step. You submit every application and reservation yourself, in your own name, with your own account and payment. We never submit permits or reservations for you.
2. Ordering
- Prices are in U.S. dollars (USD) and are listed on the Plans page. Payments are processed securely by Stripe (plans) and Cal.com/Stripe (calls). Your bank may charge foreign-transaction fees.
- After you pay, you'll complete an intake form (or we'll confirm your intake). "Work starts" when we email you to confirm that your intake is complete and planning has begun.
- We may decline an order, for example when we can't do the trip justice or the timeline is too short. In that case you get a full refund.
- You must be 18 or older to buy.
3. Founding prices and promotions
Founding prices are an introductory offer for a limited period while they are posted on the Plans page. They can't be combined with other offers, have no cash value, and apply only to orders paid while the offer is posted. Call fees are credited toward a plan booked within 30 days of the call, once per client. We may end or change any promotion at any time, but not for orders already paid.
4. Delivery (fulfillment)
- What you get: a digital itinerary (PDF and/or web link) delivered by email to the address you gave us.
- Turnaround: 7–10 days for every plan, counted from when work starts. Rush orders (+50%) move to the front of the line, and we'll confirm the delivery date with you before you pay. Turnaround estimates aren't guarantees. We'll tell you promptly if we expect a delay.
- Calls take place by video at the time you booked. If you're more than 10 minutes late, the call may be shortened or count as held.
- Included revisions: each plan includes 1 round of revisions requested within 14 days of delivery. Extra rounds are $35 each. A revision means changes within the original trip scope (same general destination, dates and group). A new destination or a major change in dates or scope is a new plan.
5. Refunds, cancellations and changes
- Before work starts: cancel for a full refund. Email hello@fiftyandnorth.com.
- After work starts but before delivery: no refund, but you can reschedule for free: pause the work and pick it back up within 12 months.
- After delivery: no refunds. A plan is custom, personal work, and once delivered it can't be returned. Your remedy is revision. If something in your plan is wrong or doesn't fit the brief you gave us, tell us within 14 days and we'll fix it under the included revision(s), and we'll fix factual errors at no charge.
- If we don't deliver (other than because of a delay you cause, such as an unreturned intake), you get a full refund.
- Calls: reschedule or cancel at least 24 hours ahead for a full refund. Within 24 hours or no-show: no refund. If we cancel, you get a full refund or reschedule.
- Trail Notes and other pre-made downloads: no refunds once downloaded, except for a defective file.
- Your trip itself: if your trip is cancelled or changed for any reason (weather, fire, closures, illness, supplier cancellation, government action), no refund is due for planning already delivered. We'll gladly provide a revision for new dates within 12 months at the extra-revision rate.
- Approved refunds go to the original payment method through Stripe and usually take 5–10 business days to appear.
- If you have a problem, please contact us before disputing a charge with your bank. We'll work with you to resolve it.
6. Outdoor activities: assumption of risk (please read)
Outdoor adventure travel is inherently dangerous. Hiking, backpacking, climbing, scrambling, paddling, boating, swimming, skiing and snow travel, wildlife viewing, driving remote or unpaved roads, and travel in wilderness, backcountry, coastal, tidal, high-altitude, desert, cold or remote areas involve risks that can cause serious injury, illness, property damage or death. These risks include falls, rockfall, avalanches, drowning, tides and rogue waves, flash floods, lightning, wildfire, extreme heat or cold, altitude illness, wildlife encounters (including bears and moose), getting lost, vehicle accidents, lack of cell service, and delayed rescue or medical care.
By using our Services, you agree that:
- You choose and do every activity voluntarily and at your own risk, and you assume all of these risks for yourself and anyone traveling with you, including minors in your care.
- Our plans are information only. They are not instruction, guiding, supervision or a safety assessment. We don't know your real-time conditions, and conditions change fast. Trail, road, weather, snow, tide, fire, closure, permit, fee and hours information can be outdated or wrong.
- You'll verify everything with official sources (for example the National Park Service, Parks Canada, the USDA Forest Service, BLM, state and provincial parks, NOAA/National Weather Service, Environment Canada, avalanche centers and tide tables) before and during your trip, and you'll follow all posted rules, closures and ranger guidance.
- You're responsible for judging whether each activity fits your group's fitness, skill, experience, health and equipment; carrying proper gear, navigation, food, water and emergency communication; getting any medical advice you need; and turning back when conditions or your group call for it. Difficulty ratings and time estimates are general guides only.
- You'll consider buying travel insurance and rescue/evacuation coverage.
7. Release and limitation of liability
To the fullest extent allowed by law:
- You release Fifty & North and its owner, Kevin Tantillo, and anyone who helps with the work, including co-planners and contractors, from any claims for injury, illness, death, property damage, or loss arising from your trip, any activity, any travel supplier, or your use of or reliance on our plans, except where caused by our gross negligence or willful misconduct.
- Our Services are provided "as is," without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee availability, prices, permits, weather, conditions, or that any trip will go as planned.
- We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost trips, bookings, fees, or time.
- Our total liability for any claim relating to the Services is limited to the amount you paid us for the specific Service involved.
Some states and provinces don't allow certain exclusions or releases. In those places, our liability is limited to the smallest amount the law permits.
8. Indemnity
You agree to indemnify and hold harmless Fifty & North and its owner, Kevin Tantillo, from claims, losses and costs (including reasonable attorneys' fees) that arise from your trip, your activities, your breach of these Terms, or claims by people traveling with you, to the extent allowed by law.
9. Your information and responsibilities
You'll give us accurate, complete information about your group, including ages, abilities and relevant health or accessibility needs. Our plans depend on it. If the information is incomplete or inaccurate, revisions to fix the result may be charged.
10. Intellectual property
Your plan is licensed to you for personal, non-commercial use by you and your travel group. You may print it and share it with your group. You may not resell, publish or redistribute it, or use it to train AI models. Site content, photos, the Fifty & North name and logo, and Trail Notes belong to us. With your permission only, we may publish an anonymized version of your trip as an example.
11. Links and third parties
Plans and the Site link to third-party sites. We don't control them and aren't responsible for their content, accuracy or practices.
12. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in the State of Georgia, except that either party may bring a qualifying claim in small-claims court. Nothing in these Terms limits rights you have under consumer-protection laws that can't be waived.
13. Changes, severability and entire agreement
We may update these Terms, and the version posted when you paid applies to your order. If any part is found unenforceable, the rest stays in effect. These Terms, the Plans page and our Privacy Policy are the entire agreement between us about the Services.
